General Information
The service company offers the services listed in the annex according to the state of the art and with the care of a diligent entrepreneur, while protecting the interests of the customer as best as possible.
General Provisions
The General Terms and Conditions apply to all services and deliveries of goods provided by the service company. For services that are provided at a specific time, such as booked rides, there is no right of withdrawal. Unless otherwise agreed, these terms and conditions are considered an essential part of the contract concluded between the service company and the customer.
Assignment of Contract
In principle, the contract issued is recorded in a contract form. The services to be provided are specified in detail, and the customer receives a copy. By signing the contract form and scheduling a date, the booking becomes binding and can only be canceled according to the „Cancellation Policy“ described below.
Prices / Cost Estimate
Prices listed on display apply. If prices are communicated verbally or in writing by the service company that are expected to be charged, the following applies:
Cost estimates are, unless a binding price has been expressly agreed upon, non-binding in accordance with § 5 Abs 2 of the Consumer Protection Act (KSchG). Thus, cost estimates are not guaranteed, and the customer must accept unforeseen cost overruns of up to 50% of the fixed fee.
Should costs exceed this threshold, the service company will, if possible, inform the customer beforehand. The service company and the customer will then agree on the further course of action together.
Services / Delivery of Goods
Appointments
The service company will, as far as possible, meet the agreed deadlines for completion/delivery. Should unforeseen circumstances arise that make it impossible to meet the deadlines, the service company will propose a new date for performance/delivery and, where possible, inform the customer about any delays.
For objects left in the vehicle that are not connected to the vehicle, no liability is assumed by the service company for damage/loss caused by third parties. The service company is liable for financial losses only in cases of intent and gross negligence on its part.
Cancellation Policy
As our services are provided at a specific time, there is no statutory right of withdrawal for customers who book a ride in accordance with § 18 Abs 1 Z 10 of the Distance and Off-Premises Contracts Act (FAGG).
Our Voluntary Cancellation Policy
We offer the option to cancel your booking under the following conditions:
- Free cancellation up to 48 hours before the scheduled time.
- For cancellations less than 48 hours before the scheduled time, 50% of the booking amount will be charged.
- For cancellations less than 24 hours before the scheduled time, the full booking amount will be charged.
For questions regarding cancellations, please feel free to contact us at [contact information].
Payment
Prices listed on display apply. Unless otherwise agreed (see Cost Estimate), the customer must pay the total amount stated on the invoice immediately after receipt. Payment terms are as specified in the service company’s display.
The service company is entitled to request a reasonable advance payment when the contract is awarded. The customer can only offset claims by the service company if the counterclaim is undisputed or has been legally established.
Complaints
Complaints should be made by the customer as promptly as possible. For entrepreneurs, the duty to notify defects under the UGB (Austrian Commercial Code) applies.
Place of Performance / Jurisdiction
If the customer is not a consumer under the KSchG (Consumer Protection Act), the court at the location of the service company’s registered office has exclusive jurisdiction for all disputes. For consumers, the competent court is the one in whose district the customer’s residence, habitual abode, or place of employment is located. If the customer relocates their residence, habitual abode, or place of employment abroad after the conclusion of the contract, the aforementioned court remains competent.
